By accessing or using the website at concretecompanymidland.com (the "Site"), by submitting a contact or estimate request, or by engaging Midland Concrete to perform any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or services. We may update these terms from time to time. The current version will always be posted on this page with the effective date shown above.
Midland Concrete provides residential and commercial concrete contracting services in Midland, MI and surrounding communities in mid-Michigan. Services include concrete driveway installation, patio and flatwork construction, foundation work, decorative and stamped concrete, retaining walls, floor installation, pool decks, sidewalks, footings, concrete cutting, and related services. The specific scope of work for any project is defined in a written estimate or contract provided before work begins.
All estimates provided by Midland Concrete are based on conditions observed during a site visit and information provided by the customer at the time of the estimate. Estimates are provided in writing and are valid for 30 days from the date issued unless otherwise noted.
Prices in a signed estimate or contract are fixed for the agreed scope of work. Changes to the scope of work requested by the customer after a contract is signed may result in additional charges. Any change that affects the price will be communicated to the customer in writing before additional work is performed. We do not charge for on-site estimates.
Project scheduling is confirmed in writing after a contract is signed. Start dates are subject to weather conditions and permit timelines. Concrete work cannot be performed in temperatures below approximately 40 degrees Fahrenheit, and we reserve the right to reschedule work due to weather at no penalty to either party.
If a customer cancels a scheduled project after a contract is signed, any deposit paid may be retained to cover materials ordered or preparatory work already performed. Cancellations must be made in writing by email or letter. We reserve the right to cancel or reschedule a project if site conditions differ materially from those observed during the estimate.
Payment terms are outlined in the written contract for each project. Typically, a deposit is required before work begins, with the balance due upon substantial completion of the project. Final payment is due within the number of days specified in the contract.
Invoices not paid by the due date may be subject to a late payment fee as specified in the contract. Midland Concrete reserves the right to suspend or discontinue work on any project where payment is overdue. The customer is responsible for any reasonable collection costs, including attorney fees, incurred to collect outstanding amounts.
The customer is responsible for providing accurate information about the property and the scope of work during the estimate process. The customer must ensure that access to the work area is clear on scheduled work days. Unless otherwise agreed in writing, the customer is responsible for removing vehicles, equipment, and other obstructions from the work area before the crew arrives.
The customer is also responsible for notifying Midland Concrete of any underground utilities, irrigation systems, buried cables, or other subsurface conditions that may affect the work. Midland Concrete is not responsible for damage to unmarked underground utilities or structures.
Where required by law, Midland Concrete will obtain applicable building permits on the customer's behalf prior to beginning work. Permit fees are included in the project estimate unless otherwise stated. Work is performed in compliance with applicable local codes and regulations. Customers may not request that permit requirements be bypassed. Any work performed outside of the agreed and permitted scope at the customer's direction is at the customer's sole risk.
Midland Concrete warrants that work will be performed in a workmanlike manner using materials appropriate for the application. Any specific warranty terms are outlined in the written contract for the project.
Concrete is a natural material subject to cracking, color variation, and surface wear over time. Minor cracking, surface discoloration, and variations in finish texture are inherent characteristics of concrete and are not considered defects. Control joints are placed to manage cracking, but cannot eliminate it entirely. Warranty coverage does not extend to damage caused by improper maintenance, chemical de-icers, vehicle overloading, acts of nature, or conditions not disclosed at the time of estimate.
Except as expressly stated in a written warranty, Midland Concrete makes no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
To the fullest extent permitted by law, Midland Concrete will not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services or website, even if we have been advised of the possibility of such damages.
Our total liability to any customer for any claim arising from services we provide shall not exceed the total amount paid by the customer for the specific project giving rise to the claim. This limitation applies to all claims, including those based on contract, warranty, negligence, or any other legal theory.
If a dispute arises between a customer and Midland Concrete relating to our services, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, either party may pursue available legal remedies.
Any legal action arising from our services or these Terms must be filed in the state or county courts with jurisdiction over Midland, MI. Both parties consent to the exclusive jurisdiction of those courts for any such action.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.
